1. General
1.1 The test applicant, for either a driving theory test or a practical driving test, is expected to have read and understood the terms and conditions, the house rules and the sanction guidelines of the CBR before applying.
1.2 The CBR driving theory tests and the CBR practical driving tests can only be applied for by following the procedure as determined by the CBR.
1.3 The test fee must be paid on time by or on behalf of the candidate in accordance with the payment regulations. If a test does not take place due to circumstances for which the CBR cannot be held responsible, then the test fee will not be refunded. The candidate must pay again to take the test. Exceptions can be made under certain circumstances as determined by the CBR.
1.4 The CBR only accepts one application at a time per candidate for the same test.
1.5 If a candidate already has a valid driving licence, then the driving theory test or practical driving test cannot be taken again for the categories for which the driving licence is valid, except on grounds pursuant to statutory provisions. A candidate in possession of a satisfactory theory test result and/or certificate for a category cannot take the theory test for the same category again until three months before the expiration of the satisfactory result.
1.6 A test can be stopped and/or declared invalid if the candidate acts in violation of the house rules, behaves as mentioned in the sanction guidelines and/or does not follow instructions or requests made by CBR employees. The CBR is not liable for any subsequent costs made by and/or damages suffered by the candidate.
1.7 The candidate has read and understands the terms and conditions for obtaining a driving licence. If the local authority or the Ministry of Transport/Department of Road Transport decides not to issue the driving licence after a successful test, then the CBR cannot be held responsible for the costs made by the candidate or the driving school for the driving lessons and the tests.
1.8 If the applicant provided inaccurate details when applying for the test, then the test results will not be given and there will be no refund of the test fee. Should the inaccurate details be discovered after the test results were given, then the test results will still be declared invalid and there will be no refund of the test fee.
1.9 The CBR will do its utmost to keep to the scheduled time and location of the test. In some urgent cases, the CBR and the examiner may determine a different time or location. The costs and/or damages are not eligible for reimbursement.
1.10 Members of the Supervisory Board, the management and the driving test managers of the CBR have the authority to attend or partially attend a driving theory test and/or a practical driving test. This also applies to other persons who have been authorized to do so by the CBR.
1.11 Candidates must abide the CBR house rules and follow instructions and requests made by CBR employees. If a candidate violates the house rules, behaves as mentioned in the sanction guidelines and/or does not follow the instructions or requests made by CBR employees, then the CBR will penalize according to the sanction guidelines. Depending on the nature of the violation, the CBR can disqualify the candidate from taking the test for a certain period of time.
1.12 The CBR will report suspected or confirmed fraud or any other offence.
2. Driving theory test
2.1 In order to take the test, the candidate must report to the theory test centre in plenty of time before the test starts and must prove his/her identity with an ID that is accepted by the CBR. If a candidate with a booking has not reported and proven ID in the theory test centre at least five minutes before the test starts, then he/she can no longer claim the booking. There is no admittance to the test without a booking.
2.2 The results of the theory test will only be announced after it has been confirmed that the candidate is officially registered in the administration of the local authorities, save in exceptional cases which have been explicitly documented by law and/or regulations.
2.3 Candidates are not allowed to use mobile devices, transmitting and/or receiving equipment or recording equipment in the test room. The penalty will be exclusion from the test in accordance with the sanction guidelines.
2.4 A satisfactory theory test result is valid for one and a half years as of the date of passing the test
3. Practical driving test
3.1 It must be determined that the candidate meets the physical and mental requirements needed for the relevant driving licence category before the practical driving test takes place.
3.2 In order to take the test, the candidate must report to the examiner at the time and location scheduled with the CBR. If the examiner is not able to conduct the test at that moment, the candidate should wait and report again as soon as the examiner is available. In order to be admitted to the test, the candidate must prove his/her identity with an ID that is accepted by the CBR.
3.3 Before the test starts, the candidate must give the examiner the driving test appointment form which states that the candidate has read and understands the test terms and conditions, the house rules and the sanction guidelines. The candidate must sign this form in the presence of the examiner.
3.4 The candidate cannot take the test if the candidate has been disqualified from driving a motor vehicle. Furthermore, the candidate cannot take the test if the driving licence which is compulsory for the practical driving test has been suspended or revoked under the law on administrative enforcement of traffic regulations.
3.5 If a candidate drives a motor vehicle during a practical driving test, with or without supervision, then he must comply with all conditions set by the 1994 Road Traffic Act, regulation on motor vehicles, regulation on driving licences, 1990 Traffic Rules and Signs Regulations and other statutory regulations of importance with regard to driving a motor vehicle.
3.6 The candidate must have disposal of a motor vehicle or the combination of a motor vehicle and a trailer for the relevant driving licence category. The candidate and the owner or keeper of the motor vehicle or the combination, are responsible for the technical state of the vehicle which must meet the legal requirements. Furthermore, the motor vehicle or the combination must comply with any further standards set by the CBR. The examiner can decide not to conduct the test if the motor vehicle or the combination does not meet the necessary requirements.
The CBR is not liable for any costs and/or damages resulting from this decision. The CBR and the examiner are not responsible or liable for any damages which occurred during a test with a motor vehicle or combination of a motor vehicle and trailer.
3.7 The name of the driving school should dominate any other possible emblems on the motor vehicle or combination of a motor vehicle and trailer. This is to be solely determined by the examiner. The examiner can decide not to conduct the test if the motor vehicle or the combination does not meet the necessary requirements. The CBR is not liable for any costs and/or damages resulting from this decision.
3.8 After a candidate has passed a practical driving test, the positive test result is registered electronically. In case of a malfunction, this will be done in writing. The candidate confirms this result by means of an electronic or written signature, with the examiner present. Without this confirmation, the driving competence certificate cannot be registered in the driving licence register of the Ministry of Transport/Department of Road Transport (RDW). Without this registration, no driving licence can be issued.
4. Registration
4.1 After passing the practical driving test, the results are electronically registered as a driving competence certificate in the driving licence register of the Ministry of Transport/Department of Road Transport. This certificate is valid for three years after registration.
4.2 After a positive determination of the fitness to drive, the fitness certificate is electronically registered in the driving licence register of the Ministry of Transport/Department of Road Transport. This certificate is valid for one year after registration.
4.3 If any delay should occur in the electronic transfer of the driving competence certificate and/or the fitness certificate to the driving licence register of the Ministry of Transport/Department of Road Transport, then the CBR is not liable for any costs and/or damages caused by this delay
